Terms of Service

1. The Service

Unicorns Tracker is an app-intelligence platform focused on iOS. It aggregates and analyzes publicly available data from Apple's App Store feeds to provide market analysis, chart rankings, competitor tracking, and related insights. The Service is provided on a "software as a service" basis over the internet.

Unicorns Tracker is not affiliated with, endorsed by, or sponsored by Apple Inc. "Apple", "App Store", and related marks are trademarks of Apple Inc.

2. Accounts

To use the Service you must register an account. You must provide accurate information, keep your credentials confidential, and notify us immediately if you suspect unauthorized access. You are responsible for all activity on your account.

You must be at least 16 years old to create an account.

3. Subscriptions, billing, and refunds

3.1 Plans and billing cycles

Paid features are offered on monthly or annual subscription plans, billed in advance via Stripe. Prices are shown on the pricing page at the time of checkout and are exclusive of applicable taxes (VAT is added where required by Polish and EU law).

3.2 Auto-renewal

Subscriptions renew automaticallyat the end of each billing period unless you cancel before renewal. You can cancel at any time from your account billing page. Cancellation takes effect at the end of the current billing period — you keep access until then.

3.3 No refunds for partial periods

Payments are non-refundable. If you cancel mid-cycle you will not be charged for the next period, but we do not issue partial refunds for the unused portion of the current period. This does not affect any statutory refund rights you may have under applicable consumer protection law.

3.4 Price changes

We may change subscription prices. Changes take effect at the start of the next renewal period and will be communicated to you at least 30 days in advance by email. If you do not agree, you may cancel before the change takes effect.

3.5 Failed payments

If a payment fails, we may retry the charge and may suspend or downgrade your account until payment is resolved.

4. Acceptable use

You agree not to:

• Scrape, crawl, or bulk-extract data from the Service's UI or API, including through automated tools, headless browsers, or any undocumented interface
• Resell, redistribute, or sublicense data obtained from the Service to any third party
• Reverse engineer, decompile, or disassemble any part of the Service, except to the extent this restriction is prohibited by applicable law
• Circumvent rate limits, authentication, or any technical protection measure
• Use the Service to build a competing product
• Upload malware or attempt to disrupt the Service for other users
• Use the Service in violation of any applicable law, including export-control and sanctions laws

We may suspend or terminate accounts that violate these rules, without refund.

5. Intellectual property

The Service, including its software, design, text, graphics, aggregated analytics, and compilations of public App Store data, is owned by Unicorns Tracker Sp.o.o. and protected by copyright, database rights, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes during your subscription, subject to these Terms.

All rights not expressly granted are reserved.

6. Data sources and accuracy

Unicorns Tracker analyses third-party data from Apple's public feeds. Although we take reasonable care, we do not warrant that the data is accurate, complete, current, or uninterrupted. You are responsible for any business decisions you make based on the Service.

7. Third-party services

The Service integrates with third-party vendors (Stripe, Supabase, Google, OpenAI, Vercel). Your use of those vendors is subject to their respective terms. We are not responsible for their acts or omissions.

8. Warranty disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

9. Limitation of liability

To the maximum extent permitted by law:

• Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if advised of their possibility.
• Our total aggregate liability arising out of or in connection with these Terms is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law (for example liability for gross negligence, wilful misconduct, or death and personal injury caused by negligence).

10. Indemnity

You agree to indemnify and hold Unicorns Tracker Sp.o.o.harmless from any claim, demand, loss, or damages — including reasonable legal fees — arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if your payment fails and is not cured, or if we reasonably believe your use is harmful to the Service or other users. On termination, sections 5, 8, 9, 10, 12, and 13 survive.

12. Governing law and disputes

These Terms are governed by the laws of Poland, excluding its conflict-of-law rules. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the competent courts of Warsaw, Poland. If you are a consumer resident in the EU, this clause does not deprive you of the protection of mandatory consumer-protection rules in your country of residence.

13. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy and Cookies Policy, constitute the entire agreement between you and Unicorns Tracker Sp.o.o. regarding the Service.
• Severability. If any provision is held unenforceable, the remainder remains in effect.
• No waiver. Our failure to enforce a right is not a waiver of it.
• Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or in connection with a merger or sale of assets.
• Changes. We may update these Terms. Material changes will be announced by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.
